{"id":32105,"date":"2026-06-18T13:52:05","date_gmt":"2026-06-18T10:52:05","guid":{"rendered":"https:\/\/thedefender.media\/?p=32105"},"modified":"2026-06-18T17:08:33","modified_gmt":"2026-06-18T14:08:33","slug":"brdo-ip-report","status":"publish","type":"post","link":"https:\/\/thedefender.media\/en\/2026\/06\/brdo-ip-report\/","title":{"rendered":"How intellectual property rights for defence innovations are regulated abroad: BRDO study"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Better Regulation Delivery Office (<a href=\"https:\/\/thedefender.media\/en\/tags\/brdo\/\" type=\"link\" id=\"https:\/\/thedefender.media\/en\/tags\/brdo\/\">BRDO<\/a>) has presented a <a href=\"https:\/\/brdo.com.ua\/wp-content\/uploads\/2026\/06\/intelektualna-vlasnist_defence_fin.pdf\" type=\"link\" id=\"https:\/\/brdo.com.ua\/wp-content\/uploads\/2026\/06\/intelektualna-vlasnist_defence_fin.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">stu<\/a>dy examining international approaches to intellectual property (IP) rights for government-funded defence innovations. The analysis covers the regulatory frameworks of the United States, the United Kingdom, Israel, Germany, France, Finland, Denmark, India and T\u00fcrkiye, as well as practices adopted by the European Union and NATO.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The study found that most jurisdictions follow a common principle: intellectual property rights to defence innovations developed with government support remain with the developer, allowing further commercialisation of the technology. At the same time, governments protect their interests through licensing mechanisms, special contractual provisions or exceptional access rights in specific circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This approach is enshrined in US legislation through the Bayh-Dole Act, reflected in grant agreements in the United Kingdom (DEFCON 705) and India (iDEX and Make-I), and incorporated into EU grant programmes such as the European Defence Fund and Horizon Europe.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link has-text-align-left wp-element-button\" href=\"https:\/\/thedefender.media\/en\/insights\/drone-ip-basics-for-developers\/\"><strong>Drones as intellectual property objects:<\/strong> what developers need to know. A column by Juscutum<\/a><\/div>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Regulatory models nevertheless vary depending on the country, the type of support provided and the broader security context. For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the United States, IP rights remain with the developer, while the government receives a royalty-free, non-exclusive licence for defence and other public purposes;<\/li>\n\n\n\n<li>In the United Kingdom, the principle of \u201cdeveloper ownership\u201d applies, with the government typically receiving a broad but non-exclusive licence for defence and national security needs;<\/li>\n\n\n\n<li>In Israel, developers retain ownership rights, but the government exercises strict control over the transfer abroad of critical technologies developed with public funding and receives a return on its investment through royalties if the company achieves commercial success;<\/li>\n\n\n\n<li>In Germany, the extent of government rights is determined on a case-by-case basis through contract terms and funding programme conditions, depending on the nature of the funding and the technology involved.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Developer ownership of IP rights is also the standard approach within NATO\u2019s innovation accelerator network DIANA and the European Defence Fund (EDF). According to BRDO, aligning with these principles is important for Ukraine as it seeks deeper integration into international defence supply chains and broader access to international financing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cInternational experience demonstrates that public funding for defence innovation can coexist with intellectual property rights remaining with the developer,\u201d said Alina Podolieva, Deputy Head of Regulatory Policy at BRDO.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BRDO experts also note that overly restrictive approaches that require the mandatory transfer of IP rights to the state may reduce private-sector participation in government grant programmes, make it more difficult to attract private investment, and weaken
